Parents Terms Conditions and Privacy Policy

Terms and Conditions – Registrations

These Terms form an agreement between DIY Fundraising Pty Ltd (Colour Blast) (ABN 51 641 654 471) (“we”, “us”, “our”) and you, the parent, guardian, or person completing the registration (“you”, “your”, “Participant”).

By completing the online registration and, where required, paying any applicable fee, you confirm that you:

  • Are aged 15 years or older and registering for yourself as a Participant, with capacity to consent in line with the Privacy Act 1988 and guidelines on adolescent consent; or
  • Are a parent or legal guardian aged 18 years or older and authorised to register and provide consent on behalf of the Participant;
  • Have read and understood these Terms;
  • Agree to comply with them;
  • Understand that these Terms and Conditions may be updated from time to time, and that it is your responsibility to review and remain in agreement with the current version posted on the Platform; and
  • Acknowledge that by accepting these Terms and Conditions, you have also read and understood our Privacy Policy.

A registration is not complete until the full registration process has been submitted online and, where applicable, payment has been received.

DIY Fundraising Pty Ltd (Colour Blast) – Overview

The Platform is an online fundraising facility operated by DIY Fundraising Pty Ltd (Colour Blast). We act as an agent for participating schools, organisations, and other approved clients (collectively referred to as “Beneficiaries”), with limited authority to facilitate the collection, accounting, and distribution of funds raised.

Our role is limited to providing the online fundraising platform and associated accounting services. Beneficiaries and registered Users are given access to tools that enable them to create fundraising campaigns, build web pages, and communicate with their networks. These activities are the sole responsibility of the relevant Beneficiary or User.

As a general principle, DIY Fundraising Pty Ltd (Colour Blast) accepts no liability for the actions or omissions of Beneficiaries or Users in relation to their use of the Platform.

We verify that all Beneficiaries are properly registered during the onboarding process. However, we are not responsible for how a Beneficiary applies funds once they have been distributed. If you are concerned about the use of donations, you should contact the Beneficiary directly.

Payment Processing

DIY Fundraising Pty Ltd (Colour Blast)  (Colour Blast)  uses trusted, PCI-compliant third-party payment providers to facilitate secure online transactions. By making a payment through the Platform, you agree to be bound by the terms and privacy policies of those payment providers, in addition to these Terms.

All offline funds collected are the sole responsibility of the Organisation and must be managed in accordance with its own policies and procedures.

Account

Access to certain Services may require the creation of an account or profile. You are solely responsible for maintaining the confidentiality and security of your account details, including usernames and passwords. You accept full responsibility for all activities carried out under your account, including any transactions made using your login credentials.

You must keep your personal login information secure at all times. This includes:

  1. Not allowing another person to use your login information or represent themselves as you;
  2. Not disclosing or allowing your login details to be discovered by others; and
  3. Regularly updating passwords or other identifiers to minimise the risk of misuse.

Indemnity for Misuse of Login Information

DIY Fundraising Pty Ltd (Colour Blast) accepts no liability for actions taken by anyone using your login details, whether authorised by you or not. You agree to indemnify DIY Fundraising Pty Ltd (Colour Blast)  (Colour Blast)  against any loss, cost, or damage arising from misuse of your account or breach of these Terms.

Fundraising Pages and User Accounts

Users who register with the Platform may establish one or more personal fundraising pages (“Personal Pages”) to raise funds in support of a participating school, organisation, or other approved client (“Beneficiary”).

All funds raised externally by a User for a Beneficiary must be directed through the Platform, except for amounts collected offline (e.g. cash), which must be provided directly to the Beneficiary in accordance with their procedures.

A Personal Page, Event Page, or Microsite may only be created for a Beneficiary that is already registered on the Platform.

We reserve the right to remove, suspend, or close a Personal Page at our discretion.

When creating a Personal Page, you must ensure that any text content you provide does not:

  • Infringe the intellectual property rights (including copyright) of any third party;
  • Damage or negatively affect the reputation of DIY Fundraising Pty Ltd (Colour Blast), Colour Blast, any Beneficiary, or any affiliates or partners;
  • Mislead or deceive others as to the nature, purpose, or benefits of the fundraising activity;
  • Misrepresent your identity or affiliation with any person, organisation, or group;
  • Contain inaccurate, exaggerated, defamatory, or untrue statements;
  • Encourage or promote discriminatory, criminal, or unlawful conduct; or
  • Include offensive, suggestive, racist, violent, or otherwise inappropriate language or innuendo.

Intellectual Property Rights

For the purposes of these Terms, “Intellectual Property Rights” include, without limitation:

  • Patents, copyright, trademarks (registered and unregistered), registered and unregistered designs, circuit layout rights, trade secrets, know-how, and rights in confidential information; and
  • Any application or right to apply for registration of any of the above.

All Intellectual Property Rights in the Platform are owned by, or lawfully licensed to, DIY Fundraising Pty Ltd (Colour Blast).

You must not:

  • Claim ownership of, or rights to, the Intellectual Property Rights in the Platform;
  • Copy, adapt, modify, decompile, disassemble, reverse engineer, or otherwise attempt to derive the source materials of the Platform, nor authorise others to do so; or
  • Use any content from the Platform without prior written consent from DIY Fundraising Pty Ltd (Colour Blast) or, where applicable, the third-party licensor of those rights.

No Warranties

DIY Fundraising Pty Ltd (Colour Blast)  (Colour Blast)  will use reasonable efforts to keep the Platform operational and secure. However, we do not guarantee uninterrupted access or error-free operation.

To the fullest extent permitted by law, all warranties, conditions, or guarantees not expressly stated in these Terms are excluded.

Limitation of Liability and Indemnity by Users

To the maximum extent permitted by law, DIY Fundraising Pty Ltd (Colour Blast) will not be liable for direct, indirect, incidental, consequential, or special damages of any kind, including (but not limited to) lost profits, lost data, business interruption, or reputational damage, arising from:
a) Your use or misuse of the Platform;
b) Any content uploaded by Users;
c) The conduct or representations of Beneficiaries; or
d) Any breach of these Terms by a User.

Users agree to indemnify and hold harmless DIY Fundraising Pty Ltd (Colour Blast), its officers, employees, and partners from any claims, costs, or damages arising from their use of the Platform, their content, or their breach of these Terms.

Jurisdiction

These Terms are governed by the laws of Queensland and the Commonwealth of Australia. By using the Platform, you submit to the exclusive jurisdiction of the courts of Queensland.

General

These Terms, together with our Privacy Policy, form the entire agreement between you and DIY Fundraising Pty Ltd (Colour Blast) regarding your use of the Platform, and replace any prior agreements or communications.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

All amounts displayed are in Australian Dollars unless otherwise specified.

Terms and Conditions – Events

HOSTED Events

A “Hosted Event” is an event coordinated and delivered by DIY Fundraising Pty Ltd (Colour Blast) in partnership with the participating school, organisation, or community group. Unlike DIY Events, Hosted Events involve operational involvement by DIY Fundraising Pty Ltd (Colour Blast) in the planning and delivery of the event.

By registering for an event that is HOSTED, you acknowledge and agree to the following:

  • Consent to Participate
    You understand that you, your child, or the person you are registering (as their parent/legal guardian) will be participating in a Hosted Colour Blast Event coordinated by the school/organisation in partnership with DIY Fundraising Pty Ltd (Colour Blast). You consent to their participation in all event activities.
  • Acknowledgement of Risk
    You understand that while reasonable steps are taken to provide a safe environment and minimise risks, participation in a Hosted Colour Blast Event involves inherent risks of injury or illness. These may include, but are not limited to, slips, trips, falls, overexertion, dehydration, and contact with event materials (e.g. colour powder, water, land-based inflatables).
  • Health Information
    You confirm that the information you have provided to the school or organisation regarding yours, your child’s (or participant’s) health, medical conditions, and emergency needs is accurate and complete to the best of your knowledge.
  • First Aid and Emergency Treatment
    You authorise event staff, school staff, or volunteers to provide first aid if required. In the case of a medical emergency, you consent to appropriate treatment being provided or arranged, including transport to medical facilities, and you accept responsibility for any associated costs.
  • Insurance
    You acknowledge that the organisers hold current Public Liability Insurance in respect of the Hosted Event. This insurance does not replace your own personal accident, health, or ambulance cover.

Hosted Events – Participants Should:

  • Wear enclosed shoes at all times on the track and in activity areas.
  • Wear suitable clothing for a physical event – light, comfortable, and appropriate for movement (clothes may also get colour powder or water on them)
  • Ensure you are in good health before participating. Anyone feeling unwell or recently injured should not take part.
  • Follow all safety instructions provided by Colour Blast staff, school staff, or event volunteers.
  • Stay hydrated by drinking water before, during, and after the event.
  • Use sunscreen and sun protection (hats, sunglasses, sunscreen) as required.
  • Keep valuables at home – the event is active, and items may be damaged or lost.
  • Wear suitable clothing –
  • Respect others on the track – no pushing, shoving, or unsafe behaviour.

Hosted Events – Participants Should Not:

  • Participate without enclosed shoes.
  • Take part if you have a medical condition, injury, or illness that may put you at risk.
  • Bring glass bottles, sharp objects, or unsafe items onto the track or event area.
  • Engage in rough play, wrestling, or deliberate collisions.
  • Leave the track or event area without informing a supervising teacher or volunteer.
  • Interfere with equipment, inflatables, or colour stations except as instructed.
  • Use offensive, inappropriate, or unsafe language or behaviour.

Equipment Hire in Conjunction with DIY Events

Where an Organisation hires equipment from DIY Fundraising Pty Ltd (Colour Blast) for use at a DIY Event, the arrangement is strictly for the supply of equipment only. No operational services, supervision, or event staffing are included.

By registering for an event that includes equipment hire alongside a DIY event, you acknowledge and agree to the following:

  • Consent to Participate
    You understand that you, your child, or the person you are registering (as their parent/legal guardian) will be participating in a DIY Colour Blast Event, which is organised and managed by the school/organisation. You consent to their participation in all event activities, including use of equipment supplied by DIY Fundraising Pty Ltd (Colour Blast).
  • Acknowledgement of Risk
    You understand that while reasonable steps will be taken to provide a safe environment, participation in an event with equipment involves inherent risks of injury or illness. These may include, but are not limited to: slips, trips, falls, overexertion, dehydration, and contact with event materials (e.g. colour powder, water, land-based inflatables).
  • Health Information
    You confirm that the information you have provided to the school or organisation regarding your, your child’s (or participant’s) health, medical conditions, and emergency needs is accurate and complete to the best of your knowledge.
  • First Aid and Emergency Treatment
    You acknowledge that first aid and emergency treatment will be managed by the school/organisation. The school/organisation is responsible for providing appropriate medical care or arranging emergency assistance if required.
  • Responsibilities
    DIY Fundraising Pty Ltd (Colour Blast) is responsible for supplying, setting up, maintaining effective control of, and packing down the hired equipment. The school/organisation is responsible for overall event operation, participant supervision, first aid and medical response, and ensuring adequate safety measures are in place.
  • Insurance
    You acknowledge that the organisers hold current Public Liability Insurance in respect of the equipment hire. This insurance does not replace your own personal accident, health, or ambulance cover.

DIY Events

Exclusion from These Terms

DIY Events are excluded from these Event Terms. DIY events are organised and managed solely by the participating organisation, and DIY Fundraising Pty Ltd (Colour Blast) does not operate, host, or take responsibility or liability for their conduct. Any queries, responsibilities, or issues relating to a DIY Event must be directed to the organisation running the event.

Responsibility for Delivery

The Organisation is fully responsible for planning, running, supervising, and delivering all aspects of a DIY Event, including:

  • Event safety, risk management, and supervision of participants;
  • Obtaining any required permits, licences, or approvals;
  • Ensuring compliance with applicable laws, regulations, and organisational policies; and
  • Managing all staffing, volunteers, and on-the-day operations.

DIY Fundraising Pty Ltd (Colour Blast) may, at its discretion, provide the Organisation with suggestions, templates, or guidance (for example, track layouts, schedules, or event flow ideas). These suggestions are provided for convenience only and are not binding. The Organisation remains solely responsible for deciding whether to adopt, modify, or disregard them.

No Liability

DIY Fundraising Pty Ltd (Colour Blast) does not accept responsibility or liability for the conduct, management, or outcomes of a DIY Event. Specifically, we are not liable for:

  • Any injury, loss, or damage arising from participation in a DIY Event;
  • The adequacy of supervision, facilities, or safety measures provided by the Organisation; or
  • Any claims, complaints, or disputes relating to the conduct of the DIY Event.

Fundraising and Financial Matters

Where a DIY Event uses the Platform for registrations or fundraising, DIY Fundraising Pty Ltd (Colour Blast)’s role is limited to providing the product, online platform and associated payment processing.

Communication

All queries, complaints, or issues relating to a DIY Event must be directed to the Organisation running the event. DIY Fundraising Pty Ltd (Colour Blast) is not required to mediate or resolve disputes between participants and the Organisation in connection with a DIY Event.

Refund Policy – Registrations

In line with our policy and Australian Consumer Law, refunds, exchanges, or credits are not available for change of mind or personal circumstance. We encourage you to carefully review your purchase and ensure you are satisfied before finalising your registration.

Refunds for Non-Enrolment

Refunds may be considered only in cases where the student holding a registration is no longer enrolled at the participating school or organisation. To qualify:

  • Eligibility: The student must no longer be enrolled with the school or organisation linked to the registration.
  • Proof: Written confirmation (such as a formal letter or certificate from the school or organisation) must be provided as evidence of non-enrolment.
  • Timing: Refund requests must be lodged no later than 14 days prior to the scheduled event date.

Refund Fee
Should a refund be approved, a fee of 1.9% of the total transaction value will be deducted to cover payment gateway transaction processing costs.

Event Changes

All registrations are connected to the school or organisation’s event schedule. If an event date changes, registrations will automatically transfer to the new date. The school or organisation will notify participants directly of any changes. The above refund conditions still apply unless enrolment status changes.
