- Donations: Donations made by credit or debit card are charged to your card immediately. Colour Blast issues a receipt by email to the email address entered at the time of the payment.
Subject to local laws, and what is said below in relation to Colour Blast, once your donation is made it can only be refunded to you if the online fundraising campaign is still active and before the funds are transferred to the school or club and with the prior written consent of the school or club to whom it has been directed. In the situation that the campaign is closed and all funds have been paid out and there are no funds available for refund, please contact the school or club directly to request a refund from them. Colour Blast will process your donation via the payment method used at the time of donating.
In the event that a school or club cancels their online fundraising to which you have donated (this does not include a “colour blast fun run event”) or there is some other reason that we cannot transfer the funds to them, we will return your donation via the payment method from which you made the donation. If we are unable to return your donation via the payment method you used, your donation will be sent to another fundraising event of similar nature, subject to the deduction of applicable transaction and payment processing fees. - How will your donation be used: Colour Blast does not represent or warrant that your donations will be used for any particular purpose and shall not be responsible for any dissatisfaction you may have regarding a school or clubs use of any donation you may make through the Colour Blast Platform or its associated services or websites powered by us or for any misuse or non-use of such donations by a school or club. After donations are made, all further dealings are solely between you and the school or club to which you donated.
Please note that recipient organisations reserve the right to use your donation for their general purposes in accordance with their practices and rules. Colour Blast shall not be responsible for ensuring that funds are earmarked for a particular appeal.
Colour Blast (or any payments processor or card brand we work with) will verify the identity of a school or club and undertake any other necessary checks before any funds raised are transferred to the school or club. Colour Blast shall have no liability to donors whatsoever for any use or misuse of donations made to the school or club page. The Colour Blast fundraising page may state that school or club will use donations only for specific purposes, but Colour Blast cannot guarantee that they will use them for such purpose. If you have any doubts as to how the money will be spent you should contact the school or club directly to seek reassurance. It is your sole responsibility, as a user of the Colour Blast platform to ensure that the cause stated to be supported on a relevant school or club page is one that you wish to support. - Assignment: The donation is allocated to the profile you have made the donation to via the website. The Donation cannot be transferred or assigned to another Participant.
- Offline Donations: All offline donations are done via the school or club organisation and approved by the school. These donations are collected by the school or club from the fundraiser via the donor and deposited to the fundraising account. Then after school or club approval the offline donation is added to a participants account.
- Colour Blast fees: Fundraise For Schools and Clubs receives 5% of donations made to the school or club for service of the fundraising platform, help, processing and support.
A donation bank processing fee of 1.8% + $0.30 is added on to all donations to cover bank charges. - Unauthorised donations: When you make a donation, the transaction is final and not disputable unless unauthorised use of your payment card or other payment method is proved. If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card provider in accordance with its reporting rules. Similarly, if you experience any issues of this nature when using another payment method, such as PayPal, you should contact the provider of that payment method for assistance. We do not store your credit card details. We use the services of STRIPE, a PCI compliant company which stores your credit card data. This PCI compliant solution provides enhanced security against online fraud. However, Colour Blast provide no warranty as to Stripe’s safety or security systems.
- In the situation of a cancelled donation transaction and bank or paypal preforms a charge back. Colour Blast reserves the right to invoice or direct debit the school or club for the amount of the charge back and the school or club must agree to settle that invoice within one (1) month of the date of the invoice. In the situation of the participant receiving a incentive before the charge back is processed. The school or club will be charged for the full amount including incentives.
- Information: Colour Blast is not an accounting, taxation or financial advisor, and you should not rely on information given on the website or its associated services to determine any consequences of making a donation to a school or club. Colour Blast will never email or phone you and ask you to provide all of your payment details.

- GENERAL
- Privacy: We agree to comply with the legal requirements of the Australian Privacy Principles as set out in the Privacy Act 1988 (Cth) and any other applicable legislation or privacy guidelines.
- Email: You acknowledge that we are able to send electronic mail to you and receive electronic mail from you. You release us from any claim you may have as a result of any unauthorised copying, recording, reading or interference with that document or information after transmission, for any delay or non-delivery of any document or information and for any damage caused to your system or any files by a transfer.
- GST: Gst is not included in your donation.
- Severance: If any provision (or part of it) under these Terms is held to be unenforceable or invalid in any jurisdiction, then it will be interpreted as narrowly as necessary to allow it to be enforceable or valid. If a provision (or part of it) under these Terms cannot be interpreted as narrowly as necessary to allow it to be enforceable or valid, then the provision (or part of it) must be severed from these Terms and the remaining provisions (and remaining part of the provision) of these Terms are valid and enforceable.
- Notice: Any notice required or permitted to be given by either Party to the other under these conditions will be in writing addressed to you at the address in your account or provided at the time you order our Services. Our address is set out at the end of these Terms. Any notice may be sent by standard post or email, and notice will be deemed to have been served on the expiry of 48 hours in the case of post, or at the time of transmission in the case of transmission by email.
- Jurisdiction & Applicable Law: These terms are governed by the laws of Queensland and the Commonwealth of Australia. Each Party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts operating in Queensland.
- Entire Agreement: These Terms and any document expressly referred to in them represent the entire agreement between you and us and supersede any prior agreement, understanding or arrangement between the Parties, whether oral or in writing.

This Privacy Policy sets out our commitment to protecting the privacy of personal information provided to us or otherwise collected by us, offline or online including through this website (Site). In this Privacy Policy ‘you’ means any party that provides personal information to us and ‘we’ or ‘us’ means DIY FUNDRAISING PTY LTD ACN 641 654 471, successors and assignees.

Intellectual Property Rights: Colour Blast owns the intellectual property rights, including copyright, in all content of this website. Except as necessary for using this website on your browser, or as permitted under the Copyright Act 1968 (Cth) or other applicable laws, no material on this website may be used in any form by any process without the specific prior written consent of Colour Blast. You must not include any material on any page that infringes the intellectual property rights of others. For example, you may not include a trade mark or copyright material without consent of the owners or you will be liable not Colour Blast. If we receive your personal information from third parties, we will protect it as set out in this Privacy Policy.

Colour Blast reserves the right remove any content without consultation. Colour Blast also reserves the right to prohibit fundraisers who breach these Terms of Use from using the Colour Blast website in the future. Colour Blast, at times, uses third party systems to filter inappropriate or terms that could be classed under the act of Bullying and reserve the right to block any terms as filtered.
Access: You may request details of personal information that we hold about you, in certain circumstances set out in the Privacy Act 1988(Cth) (Privacy Act). An administrative fee may be payable for the provision of information. We may refuse to provide you with information that we hold about you, in certain circumstances set out in the Privacy Act.
Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us by email. We rely in part upon customers advising us when their personal information changes. We will respond to any request within a reasonable time. We will endeavour to promptly correct any information found to be inaccurate, incomplete or out of date.
Complaints: If you believe that we have breached the Australian Privacy Principles and wish to make a complaint about that breach, please contact us by email setting out details of the breach. We will promptly investigate your complaint and respond to you in writing setting out the outcome of our investigation, what steps we propose to take to remedy the breach and any other action we will take to deal with your complaint.
